Earthrevealed Media Services Rates

The Earthrevealed Media Services rates are based on costs per month or cost per year and excluding VAT. Our rates are subject to change. Check our rates regularly for changes. Liability

Earthrevealed Media Services can only be held responsible for damages of any kind resulting from not or not in time placing of the ad or resulting from errors in the add in case of a glaring error and/or foul play. The liability is limited to the costs of the ads. Earthrevealed Media Services will notify you when the ad will be published. When the ad is published for the first time you are obliged to check the ad for errors and to notify us in case there are errors in the ad. When the ad is published repeatedly Earthrevealed Media Services can only be held responsible for errors which are mentioned to us after the first placement but before the second placement. You indemnify Earthrevealed Media Services against third-party liability as a result of the ads entered by you.

Payment

Payment is due within 30 days after the invoicedate. When no payment is received or when the payment is not received in time Earthrevealed Media Services will not only present you with the interest due but also with the costs for lawyers, bailiffs and collection agencies. All ads have to be paid in advance. All the costs involved in pre-payment are on account of the advertiser. The ad will be published as soon as the payment has been received.

Cancelation and Termination

All contracts for advertising have a minimum contractperiod of six (6) months. At any time you may cancel the ad with one (1) months prior written notice. For Clarity and by way of example, you agree to run an ad from 1 July till 1 March and for whatever reason you decide to cancel the contract on 28 October. You will be responsible and held accountable for the minimum contract period of six (6) months. Meaning you will have to pay for the period 1 July till 1 January. If you should cancel the same contract on 6 January, you will be responsible and held accountable for the period of one (1) more month, till 6 February.

Either party may terminate the contract at any time if the other party is in material breach of its obligations hereunder that is not cured within 10 days after written notice thereof from the nonbreaching party.

One-Page-Ads & Advertorials

Print and sign this contract and send it back to us. Send a text of maximum 5000 words, maximum 3 pictures (JPEG or GIF) and the target-URL to advertising@earthrevealed.com . When we have received your payment the ad will be placed. The pictures should have a minumum resolution of 640*480 pixels. Conditions

Earthrevealed Media Services reserves the right to refuse or cancel the publishing of ads without reason.

All contracts must be printed, signed an returned to us by POSTAL mail, unless stated otherwise by Earthrevealed Media Services. Contracts returned by e-mail are not accepted.

The agreement shall be governed by Dutch law and the advertiser and Earthrevealed Media Services submit to the exclusive jurisdiction of the Dutch Courts.

Disputes

You agree to indemnify and hold harmless Earthrevealed Media Services for any loss, liability, claim, damage, and expenses (including reasonable attorneys'fees) arising from or in connection with your content. In the event that Earthrevealed Media Services receives a complaint that your content infringe intellectual property rights or otherwise is unlawful, Earthrevealed Media Services shall request written substantiation of the complaint from the complaining party, for example, substantiation of proof of ownership in the form of a trademark, service mark, patent or copyright registration and we will take such steps that we believe to be appropriate under the circumstances, including, for example:

• Suspend your content or part of your content, immediately until the dispute is resolved;
• Provide you with contact information for the complaining party;

• Take the following action based on the progress of the dispute:

  • If legal action is pending or the dispute is not settled, your content or part of your content, may remain suspended until resolution is reached and Earthrevealed Media Services is notified by both parties as to the outcome;
  • If a resolution is reached between the parties, your content or part of your content, will be reactivated with any mutually agreed upon modifications.
  • If a copyright, trademark, patent, or other infringement is obvious Earthrevealed Media Services also reserves the right, instead of following the above stated procedures, to delete all your content without any warning.
